1. Disclaimer
Corporate Airtime does not guarantee the availability of services offered on this website ("the Services") or the accuracy of the information and/or images on this website or make representations or warranties, whether express or implied. It assumes no liability or responsibility for the proper performance of this website and/or the Services and/or the information and/or images contained on this website, and the Services are thus used at the own risk of the USER.
In particular no warrantee is made that the Services will meet the requirements of the USER, be uninterrupted, timely, secure or error free.
2. Indemnification
The USER, accordingly indemnifies and holds Corporate Airtime harmless against all and any loss, liability, actions, suites, proceedings, costs, demands and damages of all and every kind, (including direct, indirect, special or consequential damages), and whether in an action based on contract, negligence or any other action, arising out of or in connection with the failure or delay in the performance of the Services offered on this website, or the use of the information and/or images available on this website.
3. Use of Services
3.1 The USER may only use the Services for lawful purposes and warrants that it shall not:
3.1.1 use the Services to receive or transmit material which is in violation of any law or regulation,
which is obscene, threatening, racist, menacing, offensive, defamatory, in breach of confidence,
in breach of any intellectual property rights, or otherwise objectionable or unlawful;
3.1.2 use the Services for the transmission of "junk mail", "spam", "chain letters",
or unsolicited mass distribution of MESSAGES;
3.1.3 other than for personal and non commercial use, store on a computer, or print copies of extracts
from this website, and may not, other than for personal and non commercial use,
"mirror" or cache information provided via this website on a server, or copy, adapt, modify or re use
the text or graphics from this website without prior written permission from Corporate Airtime.
4. Privacy
4.1 Whilst the name and cell phone number of the USER which is supplied to Corporate Airtime when registering for the
Services will not automatically be made available to the recipient of a message,
Corporate Airtime nevertheless is able to trace the source of an MESSAGE,
and such information will be made available to the authorities if required by law.
4.2 Corporate Airtime will adhere to its privacy policy the salient terms of which are available to link to
and read from the home page of this website.
4.3 The USER must notify Corporate Airtime immediately should any information of the USER change.
5. Intellectual Property Rights
The USER acknowledges that Corporate Airtime owns the intellectual property rights in and to this website, and that the unauthorized use thereof is expressly prohibited.
6. Password
The USER shall keep its password secure and warrant that no other person shall use the Services utilizing its password, and acknowledges further that it is are responsible for ensuring that no unauthorized access to the Services is obtained using its password, and that it will be liable for all such activities conducted pursuant to such use, whether authorized or not.
7. Termination and Variation
Corporate Airtime reserves the right to terminate the Services to the USER in particular, or to the public in general,
without notice or reason, or to revise these terms and conditions at any time.
Such changes will be posted on this website and be deemed to have been accepted by the USER if it continues
using the Services. The obligation therefore is on the USER to review these terms and conditions at regular intervals.
8. General
8.1 These terms and conditions will be governed by and construed in accordance with the laws of South Africa.8.2 These terms and conditions are severable, in that if any provision is determined to be illegal or unenforceable by any court of competent jurisdiction, then such provision shall be deemed to have been deleted without affecting the remaining provisions of the terms and conditions.
8.3 Failure to exercise any particular rights or provision of these terms and conditions shall not constitute a waiver of such right or provision, unless acknowledged and agreed to in writing.
8.4 These terms and conditions, as varied from time to time pursuant to clause 7, above constitute the sole agreement between the parties.

9. Content of Customer Information.
Corporate Airtime undertakes that:
9.1 customer information shall be obtained only for the purpose of delivering and improving the
Services and will not be processed in any manner incompatible with this purpose;
9.2 customer information shall be adequate, relevant and not excessive in relation to the
abovementioned purpose for which it is collated and/or processed;
9.3 customer information shall be accurate, and where necessary, kept up to date and reasonable
steps shall be taken to ensure that information which is inaccurate and/or incomplete,
having regard to the purpose for which it was collected, is erased or rectified;
9.4 customer information shall be kept in a format which permits identification for no longer
than is necessary for the purpose for which the information was collected or processed.
10. Customer Consent
Customer information may only be processed if:
10.1 the customer has unambiguously given his consent; or
10.2 processing is necessary for:
10.2.1 the performance of a contract to which the customer is a party; or
10.2.2 in order to take steps at the request of the customer prior to entering into a contract; or
10.2.3 for compliance with a legal obligation to which Corporate Airtime is subject; or
10.2.4 the performance of a task carried out in the public interest or in the exercise
of official authority vested in the recipient; or
10.2.5 for purposes of the legitimate interest pursued by Corporate Airtime, except where such
interest is overridden by the interest for fundamental rights as reflected in the constitution.
10.2.6 Corporate Airtime reserves the right to make use of the users MSISDN (cell phone number),
or any other MSISDN numbers provided by the user, for commercial purposes
11. Access to Customer Information
Corporate Airtime shall ensure that:
11.1 access to, or disclosure of customer information will not be authorised without the documented
commitment of the intended recipient so as to maintain confidentiality and the rightful use of such information;
11.2 access to customer information by Corporate Airtime personnel, contract workers, consultants,
service providers or suppliers will be restricted to the level of access needed to effectively
perform delegated or contracted duties and/or the level of service needed to render a reliable
and effective service to Corporate Airtime's customers.
12. Preventative Measures
Corporate Airtime shall ensure that appropriate technical and organisational measures shall be taken against the unauthorised access, processing or disclosure of customer information.
